This Privacy Policy applies to the WeTutor-U website and related services (the Service).

1.1 Overview

WeTutor-U respects your privacy. This Privacy Policy explains what information we collect, how we use it, how we share it, and the choices you have.

1.2 Information We Collect

Information you provide

We may collect information you voluntarily provide to us, such as name, email address, mailing address (when provided), cell phone number (when provided), scheduling details, messages, learner goals and needs, and any files or content you share through the Service.

Payment information

Payments are processed by third-party payment providers. Renewed agreements will be charged to the card on file unless otherwise specified.

Automatically collected information

We automatically collect certain data, device and usage information when you engage our services. We may use cookies and similar technologies for essential functionality and analytics.

Communications

If you contact us, we may keep a record of communications.

1.3 How We Use Information

We use information to:

• Provide tutoring and related services, including scheduling and service delivery.
• Communicate about sessions, updates, reminders, and support, including by text message when a mobile number is provided.
• Process transactions and maintain accounts.
• Improve the Service, including quality, safety, analytics, and troubleshooting.
• Comply with legal obligations and enforce our terms.

1.4 How We Share Information

We may share information:

• With tutors and instructors to deliver services and support learner needs.
• With service providers that help us operate the Service such as hosting, analytics, communications, scheduling, and payments.
• For legal and safety reasons, including to comply with law and prevent misuse.
• In connection with a business transfer such as a merger, acquisition, or sale of assets.

1.5 Confidentiality

WeTutor-U treats sessions and learner information as confidential and does not share it with third parties except as necessary to provide services, as required by law, or with the consent of the learner or, where applicable, the learner’s parent or legal guardian. We may share limited information with our tutors and service providers solely for scheduling, service delivery, support, and operations.

1.6 No Recording Policy

To support privacy and confidentiality, WeTutor-U does not record tutoring sessions.

1.7 Text Messaging

If you provide a cell phone number, WeTutor-U may send text messages related to your services, such as scheduling confirmations, reminders, tutor coordination, account notices, and support communications. Message and data rates may apply. You may opt out of text messages at any time by replying STOP. After opting out, you may still receive non text communications by email. If you need assistance, reply HELP or contact info@wetutor-u.com.

1.8 Cookies and Analytics

We may use cookies and similar technologies for essential operations and analytics. You can control cookies through your browser settings. Some features may not function properly if cookies are disabled.

1.9 Data Retention and Security

We retain information as long as needed to provide services, meet legal obligations, resolve disputes, and enforce agreements. We use reasonable safeguards, but no system can be guaranteed completely secure.

1.10 Children and Student Privacy

The Service may be used by minors with parent or guardian involvement. We collect and use student information only as needed to provide tutoring services. Parents or guardians may request access to, correction of, or deletion of a child’s information, subject to applicable law.

1.11 Your Privacy Rights

Depending on your location, you may have rights to request access, deletion, correction, portability, or to opt out of certain processing. To submit a request, contact info@wetutor-u.com.

1.12 Updates to This Policy

We may update this Privacy Policy from time to time. We will post the updated version with a revised effective date.

2. Terms of Use

2.1 Acceptance of Terms

By accessing or using the Service, you agree to these Terms of Use and all policies referenced here, including the Privacy Policy and Disclaimer.

2.2 Eligibility

You must be at least the age of majority in your jurisdiction, or have parent or guardian consent, to use the Service.

2.3 Accounts and Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

2.4 Services and Tutor Relationship

WeTutor-U connects learners with tutors, instructors, and educators.

Independent Contractor Tutors

All tutors who provide services through WeTutor-U are independent contractors and are not employees, partners, agents, or representatives of WeTutor-U. Tutors control the manner and means of the tutoring services they provide, including their methods, materials, and lesson plans. WeTutor-U is not responsible for the acts or omissions of independent contractor tutors, except as required by law.

2.5 Cancellations, No Show, Credits, Refunds, and Disputes

Cancellations and rescheduling

Cancellations or rescheduling requests must be submitted at least 48 hours before the scheduled session start time. Requests made within 48 hours of the session start time will be charged in full.

Credits for late cancellations

While refunds are not provided for cancelled sessions, a full credit will be issued for use toward a future session when a session is cancelled outside of 48 hours. Credits must be used within 90 days of issuance unless otherwise stated in writing.

No show policy
A no show is defined as a learner not attending a scheduled session within 10 minutes of the
scheduled start time without prior notice. No shows are charged as a full session and are not eligible for credits or refunds.

Tutor or student not a match

On rare occasions, a tutor and student are not a match. If you are not happy with a tutor or with WeTutor-U, inform us immediately. WeTutor-U may, in its discretion, replace the tutor, credit your account, or refund unused prepaid sessions. Completed sessions are not refundable.

Disputes

If you believe there is a billing error or service issue, contact info@wetutor-u.com within 14 days of the session date. We will review the concern and respond within 3 business days.

2.6 Academic Integrity and Prohibited Requests

WeTutor-U will not complete exams, quizzes, graded assignments, or other assessed work on a learner’s behalf. We do not support cheating, impersonation, unauthorized collaboration, or plagiarism. Tutors may provide instruction, practice problems, explanations, feedback, and general editing support, but the learner remains responsible for submitting original work and complying with school policies.

Use of AI tools

While AI tools can be helpful for learning and brainstorming, WeTutor-U does not support or encourage the use of AI generated content as conclusive answers or as a substitute for the learner’s own understanding and original work. Learners remain responsible for verifying accuracy, demonstrating understanding, and complying with school policies regarding AI assistance and academic integrity.

2.7 Communications and Text Messaging Consent

By providing your mobile number, you authorize WeTutor-U to send text messages for service-related purposes such as scheduling confirmations, reminders, account notices, and support. Message and data rates may apply. You can opt out at any time by replying STOP. Opting out of texts does not opt you out of email communications related to your services.

2.8 Code of Conduct

WeTutor-U is independently owned and operated and provides tutoring services through independent contractor tutors. We do not tolerate discrimination, harassment, threats, intimidation, hate speech, sexually explicit conduct, or abusive behavior by tutors, learners, parents, or any user of the Service. If WeTutor-U determines a violation has occurred, we may immediately suspend or terminate services and accounts.

2.9 Safety and Emergencies

WeTutor-U tutors are not emergency responders. If you believe a learner is in danger or in crisis, contact local emergency services immediately.

2.10 Intellectual Property

The Service and its content are owned by WeTutor-U or its licensors and are protected by applicable intellectual property laws. You may use the Service for personal purposes unless we agree otherwise in writing.

2.11 Third Party Links

The Service may contain links to third party websites or services. WeTutor-U is not responsible for third party content, policies, or practices.

2.12 Disclaimers

The Service is provided on an as available basis.  WeTutor-U is not responsible for a student’s grades, test scores, school performance, or academic standing, and does not guarantee outcomes or admissions to any school, college, or university.

2.13 Limitation of Liability

To the maximum extent permitted by law, WeTutor-U is not liable for indirect, incidental, special, consequential, or exemplary damages, or for loss of profits, data, or goodwill.

2.14 Indemnification

You agree to indemnify and hold harmless WeTutor-U from claims arising out of your misuse of the Service, your violation of these Terms, or your violation of any rights of another.

2.15 Changes to Terms

We may modify these Terms by posting an updated version. Continued use of the Service after changes means you accept the updated Terms.

2.16 Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to conflict of laws principles. Any disputes will be brought in the state or federal courts located in Orange County, California, unless applicable law requires otherwise.

3. Disclaimer

3.1 Educational Support Only

WeTutor-U provides tutoring, academic support, and educational guidance. Tutoring is not a substitute for classroom instruction, special education services, therapy, counseling, or medical, legal, or financial advice.

3.2 No Guarantee of Outcomes

WeTutor-U is not responsible for a student’s grades, test scores, school performance, or academic standing. We do not guarantee grade outcomes or admissions to any school, college, or university. Results depend on many factors including learner effort, attendance, school requirements, and circumstances outside of WeTutor-U’s control.

3.3 Tutor Independence

All tutors who provide services through WeTutor-U do so as independent contractors accepting work under WeTutor-U and are not employees of WeTutor-U. Tutors use their own styles, methods, materials, and lesson plans based on their professional judgment and learner needs.

3.4 No Affiliation With Third Party Brands

Names of standardized tests, certifications, universities, schools, publishers, and other institutions are trademarks of their respective owners. References are for identification purposes only and do not imply endorsement, sponsorship, or affiliation with WeTutor-U.

3.5 Academic Integrity Reminder

WeTutor-U does not support cheating or plagiarism and will not complete graded work on a learner’s behalf. Learners remain responsible for original work and compliance with school academic integrity policies, including policies governing AI assistance.

3.6 Privacy Rights

4. Accessibility Statement

4.1 Our Commitment

WeTutor-U follows applicable accessibility standards and best practices.

4.2 Ongoing Efforts

We continually work to improve accessibility and usability, including reviewing content and addressing reported issues.

4.3 Third Party Content

Some content or integrations may be provided by third parties. Where possible, we encourage third parties to provide accessible experiences, but we cannot control third party accessibility.

4.4 Need Assistance or Want to Report an Issue

If you have difficulty accessing any part of the site, contact us and we will work with you to provide the information or service you need through an alternative method.
